The flagship carries the strictest terms
Ownership claims are powerful, and they are closely scrutinised. Ownership can change quickly, and a mark that stays displayed after ownership shifts creates exposure for the holder and, as the issuer, for the program. Australian regulators have previously had ownership claims declared misleading where a business became foreign owned and did not correct its position. This is why the badge specific terms for this mark require notification within five business days and immediate cessation of use, which go beyond the general fourteen day rule. The mark must also look and read nothing like the green and gold kangaroo, which is a registered mark administered by Australian Made Campaign Limited and is available only under licence from that body.
Testimonials and register entries are genuine
Any client testimonial used in the program must come from a real, identifiable certified client, because testimonials that are not genuine are a specific problem under consumer law. Register entries used for illustration must be clearly labelled as illustrative, which the current preview register does.
Independence, made demonstrable
Listing CAQA Groups as a founding member that holds its own marks undercuts the independence the program relies on, and it is exactly what a regulator or a competitor would point to. Where the founding entry is retained, the arm's length nature of that assessment must be made explicit, and it is better assessed by a reviewer independent of the group.
Environmental and AI claims carry the tightest evidence
Environmental claims and artificial intelligence claims are both areas of active regulatory attention. The criteria for Environmentally Responsible Operations and Responsible AI Use must be anchored to documented practice and to a recognised framework, and the badge specific terms restrict holders from extending the mark beyond what was certified, because loosely evidenced claims in these two areas attract the most scrutiny.
The program protects itself - so marks stay meaningful
The program makes assessments that others rely on, so professional indemnity insurance is important, and the licence agreement limits liability and requires holder indemnities for exactly this reason. The program also operates within a family of brands that sells consulting and resources into the same sector, so conflicts of interest must be identified and managed, and the independence of each assessment must be capable of being demonstrated.
